Evidence filed by Telus in secondary picketing case

What picketers did at private residences in the Telus labour dispute

The cover story in the Nov. 23, 2005, issue of Canadian Employment Law Today looked at the issue of picketing at private residences. In that case, the an Alberta court followed an earlier Supreme Court of Canada decision allowing secondary picketing, but it did slap some restrictions on what the picketers could do.

•J.P.A. — Two picketers were present in front of his home. They wore signs and were yelling "You Fucking Scab", "you're stealing my job". The shouting continued for 15 minutes. The picketers allowed him to leave his driveway when he wanted to pass. Two more picketers arrived the next morning as he was leaving.

•M.H. — Ten or eleven picketers attended at his home wearing signs. He went out onto the street to meet them. They yelled "scab", "we won't work with you when we get back to work". They allowed him to pass when he wanted to leave.

•G.D.- His wife called from the neighbours saying she was scared of picketers on the street. The picketers wrote in chalk in front of his home: "Telus Scab Lives Here" about five times with arrows pointing to his home. A brochure was left on his son's car. He started work at 7:50 a.m. and he left at 10:00 a.m. to return home to check on his family and property.

•J.E.D. — She is married to G.D. She saw eight to ten picketers in front of her house. She was at the neighbours. She went outside to confront them and told them that they had no business picketing outside of a private residence. She then called her husband. She noticed chalk graffiti on the sidewalk and road, and a flyer on her son's car. She and her neighbour took pictures of the picketers. The picketers were outside her house for approximately 15 minutes.

•S.C. — At 2:45 p.m. a car pulled up behind him at his house with two people inside. The two picketed his house for approximately 20 minutes. They returned about two minutes after they left and looked in the front window of the home "to survey the situation" and left again.

•D.B.- At 5:20 a.m. he observed four picketers outside of his home wearing signs. They honked a horn once and he heard a car door slam. He left for work at 6:55 a.m. and there were nine more picketers. One picketer was hanging over his fence and looking into his backyard. The picketers stayed until 7:20 a.m.

•K. J. — Seven picketers were outside of his house at 6:15 a.m, some were wearing signs. They left at 6:55 a.m. after the RCMP attended. His house was egged on one separate occasion, although there is no evidence as to who did the egging. He is a member of management.

•T. H. — At 6:00 a.m. he observed four picketers wearing signs, chanting "scab." Ten more picketers arrived later. He spoke to the picketers who advised that they were there to try and change his mind. The picketers told a city worker in the area that one of the scabs lived there. Some of the picketers flicked cigarette butts onto his lawn. He is a member of management. He usually leaves for work at 6:30 a.m. All of the picketers had left by 7:30.

•B.H. — She is the wife of T.H. She quit her job following the incident to be at home with her children and to thereby provide them with a sense of security. One of their children was upset by the incident and now sleeps on the floor in her bedroom.

•B.R. and C.R. — At 9:30 a.m. they observed ten picketers at their home. The picketers were carrying signs that said "Telus scab lives here." Two signs were staked into his lawn. The picketers wrote "scab," "scab lives here" and "shame" on the sidewalk and "glared" into the front window of their home. This all occurred in 30 minutes. Approximately one week before this incident someone phoned their home and their 14 year old child answered the phone. The person on the phone asked the child "how is the scab?"

•R. B. — At 10:15 a.m. there were ten picketers on the sidewalk in front of his home, some were carrying signs. He and his spouse went outside to see what was going on and shouted at the picketers to get off of their property. Two signs were staked into the lawn. They also wrote on the sidewalk: "Telus scab lives here." This lasted about 15 minutes. His home has been the target of egging on three occasions.

•E.V. — At 9:00 a.m. he observed nine picketers outside of his house. There were two signs staked into his lawn. The picketers wrote on the sidewalk with chalk "scab," "Telus Scabs" and "Shame." Two picketers "glared" through the windows. They were there for 20 minutes.
